The Failure of the 28-Clause Ceasefire Plan for Ukraine: How Peace Negotiations Continue to Stumble

Europe experienced widespread relief on Monday, as the tension caused by the introduction of a new 28-article proposal for achieving ceasefire appeared – briefly – to have been defused. A American diplomat spoke of "significant advancement" after Ukraine-US talks in Geneva. On Monday night, Moscow made its countermove: another massive barrage of missile and drone strikes on Kyiv.

The Cycle of Diplomacy and Destruction

The sequence of contrasting events captured the grim essence of the current period. By day, negotiation efforts are conducted: hopeful statements are issued from different nations. Immense energy is devoted on containing specific proposals. By night, Russian leadership brutally reminds the world that, for them, military action persists as the main instrument for achieving "settlement".

After-Dark Attacks

As the offensive progressed into the early hours of Tuesday, the immediate reality of Ukraine's defenselessness was laid bare. Ukraine is equipped to monitor missile launches from enemy soil, a capacity afforded by current data. From vantage locations, Ukrainian air force fighter jets that had been dispatched to counter approaching cruise missiles roared overhead – advanced fighter aircraft provided to Ukraine by NATO members.

Moments later, Kyiv's anti-aircraft weapons activated: several firings deployed against a Russian ballistic missile. This was a sophisticated defense system at work, probably delivered by allied countries. Every launch shakes the surroundings, shaking the windows. The moment of terror quickly gives way to resigned acknowledgment: possibly the incoming missile won't hit its mark this time, preventing destruction from catastrophe and additional electricity failures.

Persistent Threats

Soon after, a automatic firearm opened up on a drone somewhere nearby, part of a rapid response unit – most likely allied-provided weaponry. Regrettably, the bullets missed the enemy aircraft – it maintained course toward its target.

Periodically, this continued until dawn. Kyiv awoke to the daybreak reports: seven people killed, damage and infrastructure problems in multiple buildings as a result of the night's assault. As always, everyone still maintained normal activities – enduring hostilities. But those 24 hours encapsulated Ukraine's essential dependence on Western support – a reliance that regional partners are clearly incapable to substitute in the immediate future.

Ineffective Peace Efforts

The detailed framework from US administration provoked deep reactions, discussion and profound anxiety – and momentarily shifted focus from Ukraine's major integrity crisis in years. Yet, we have seen this script before, after previous diplomatic encounters and multilateral gatherings.

Every new initiative from US leadership adheres to the consistent cycle: a negotiation push against Ukraine, which Kyiv, with other European capitals, manages to fend off. They manage the tension but never actually secure success. This trend will, no doubt, continue.

Strategic Calculations

It is convenient to criticize certain parties of repeatedly advocating Moscow's conditions. But that does not seem to be the whole story. American leadership functions according to a principle well known to seasoned negotiators: you cannot win at the negotiating table what you have been unable to protect through force. The American government presumes that it is unfeasible to force Russia to surrender the land that it presently holds in Ukraine's southern or eastern regions.

The challenge is that while accepting these circumstances, American administration does nothing to discourage Russia, through words or deeds, from believing that the situation will not shift further in its benefit in the coming year.

Opposing Positions

Therefore, Moscow is confident that the clock favors them – that Ukraine and its allies are approaching exhaustion. Their motivation to agree to terms that does not give them the maximum possible gain is virtually nonexistent. There may be numerous efforts to stop fighting, but they will carry on as long as Russia's government remains completely certain in the conclusion.

On the contrary, Ukraine's government believes that Ukraine can still endure, progressively conceding people and territory but averting a complete military breakdown until conditions improve in its favour.

Present Conditions

Realistically, there are no genuine requirements for a armistice. Now, personal considerations are entering the equation: personal goals to negotiate peace and secure international recognition, and Kyiv's dual difficulties – on one hand, not to distance important partners, and on the other, to unite the population around the flag against any initiative Kyiv finds unsuitable, so that their focus does not shift toward homefront challenges. And although their task will now be much harder after latest incidents, it remains highly unlikely that this will change their overall approach.

These two forces are driving the talks.

Summary and Prospects

It took a only one week to eliminate the suggested clauses of the latest plan. Forceful and unpredictable management of the matter by US administration, resistance by Ukraine and the rest of Europe, along with soothing efforts of negotiators, and finally, recent disclosures, all served their function.

While new plans based on established approaches are approaching, Kyiv, London and other Western governments should draw one fundamental conclusion: Ukraine and Europe will only be able to fend off diplomatic offensives from Washington that are based on Russian demands and reflect specific hesitation to modify developments, if they remain united and improve their protective measures at a much faster pace. If they do, no combination of diplomatic or military actions will be able to break them. In the meantime, Ukraine's ability to defend against evening bombardments will, for the foreseeable future, largely rely on ongoing international assistance.
